Montana Takes a Sip: Governor Signs HB 211 Legalizing Beer and Wine Delivery

Beer and wine delivery will soon be legal in Montana, set to start on January 1, 2026, after the passage of House Bill 211 on Thursday. This new legislation, introduced by Rep. Katie Zolnikov from Billings, establishes a third-party delivery license for off-premises licensees, permitting them to use a delivery service and its drivers for beer and table wine delivery.

During a Senate hearing on February 18, Zolnikov mentioned that this bill had taken three years to develop. She expressed confidence in the thoroughness of the legislation, stating, “I’m pretty confident that we have thought of every situation imaginable for alcohol delivery.”

The bill includes stringent guidelines for delivery drivers. They will need to use identification scanning technology to verify the customer’s age and must complete a responsible server program. Eligible drivers must be at least 21 years old and cannot deliver to visibly intoxicated individuals. Additionally, delivery to campuses is prohibited, and potential drivers must not have any felony convictions or DUIs within the last seven years.

Alcohol must be stored in the vehicle’s cargo area, out of the driver’s reach. Interestingly, there is even a provision for bicycle delivery, though Zolnikov expressed skepticism about how common this would be, noting that it’s good to have "all of our bases covered."

The delivery sector has welcomed this new legislation. Anna Powell, a senior manager for DoorDash, stated, “By signing this bill, Governor Gianforte is putting local business, delivery workers, and customers first. We are pleased to see that beer and wine delivery will soon be available via Montana grocery stores.”

According to DoorDash statistics, the number of U.S. merchants selling alcohol through their platform surged by 37% in 2023. Drivers have reportedly earned almost 20% more on alcohol deliveries compared to other types. Powell highlighted that safe alcohol delivery enhances opportunities for businesses, delivery drivers, and consumers seeking more options.
